The Law Office of David Riojas forwarded a notice of the claim of statutory federal and state constitutional violations against his client, Hector Muñoz-Mijares stating that Mijares was unjustly removed from his position on the Board of Directors.
The letter is dated February 9, 2012.
The correspondence was sent to establish that the constitutional rights of his client were violated as he was a founding member of the board in 2011.
According to the document, Muñoz-Mijares put his abilities, experience and knowledge to contribute to the effective function of the landfill, however, he was not advised as to why he was being removed from his position on the board.
The document sent to Judge Saucedo stipulates that under the Constitution of the United States it is prohibited to discriminate against any person even people with disabilities.
It goes on to conclude that the counsel requests restitution from County Commissioner's Court to be placed back on the board, and if this is not done within a reasonable time frame, it will result in legal action taken against Maverick County for damages, attorney's fees and any other available remedy
